Please contact the gallery to enquire about freight charges, insurance and deductions for GST (or framing if applicable) on your proposed purchase.
It is of utmost importance to ART101 Gallery that our valued clients are entirely satisfied with their purchased artwork . We are not required to provide a refund or replacement if you have simply changed your mind. You can choose a refund or exchange if the artwork has a major problem. This is when the item:• has a problem that would have stopped someone from buying the item if they had known about it • is unsafe • is significantly different from the sample or description • can’t be easily fixed – this does not apply to damage which occurs after you have taken possession of the artwork or during freight/delivery to you. All artworks are checked for damage before leaving the gallery.
Alternatively, you can choose to keep the item and we will compensate you for any drop in value.
If the problem is not major, we will repair the item within a reasonable time. In the event that we elect to repair a faulty item we will endeavour to do so in a timely manner but this is entirely subject to availability from suppliers. If it is not repaired in a reasonable time you can choose a refund or replacement.
Art classes, one day workshops, short courses – We are not required to provide a refund if you change your mind about or are unable to attend the tuition services you have booked/purchased. You can receive a refund if the tuition service has a major problem.
Prices & Payment
Original Artwork: The advertised values of original artworks may from time to time attract a discount for a variety of reasons including a multiple purchase incentive. Values are set by the individual artists and the gallery may not have the authority to discount artworks by represented artists.
Commissioned Artwork: Commissioning an artist represented by ART101 Gallery for custom artwork is done so with an understanding that the commissioned work will resemble the style and quality of similar works by the artist displayed in the gallery. Artists will not create exact replicas of previously sold works or works by other artists. By commissioning an artist and accepting a quote you are agreeing to acceptance of the artwork. Once finalized and a deposit paid, commissions may not be cancelled at any time.
A quote will be provided once a thorough brief has been discussed with the gallery. Upon acceptance of a quote a deposit of 50% of the value of the artwork is required before the artist will commence your project. Artists’ processes vary and progress photos are supplied at the artist’s discretion. The balance of the payment is payable upon completion of the artwork and before collection/delivery. Freight and installation costs are not included in the cost of the commissioned artwork.
Turnaround times are entirely dependent on the artist’s workload at the time of the quote and the mediums requested. This timeframe can be anything from three weeks to 2+ months. A turnaround time for completion will be agreed at the time of the quote but will remain subject to availability of materials from suppliers. Any delays will be communicated in a timely manner but will not warrant a cancellation of the commissioned artwork.
Tuition: As spaces are strictly limited all art class, workshop and short course bookings are final, non-transferable and unless there is a major problem, all tuition is non-refundable. Please ensure that you are able to attend the advertised/booked date/s. In some instances, at the gallery’s discretion, you may transfer your booking to another attendee to participate in the booked session (workshops & short Courses only). From time to time various tuition service prices may vary including the opportunity to book a workshop or short course with an ‘early bird’ discount. Discounts vary and are applied at the discretion of the gallery. Early bird discounts expire approximately one month before an advertised date. In the event of absence for a booked weekly art class we require 48 hours notice where we will carry said booking over to the following week only. Less than 48 hours notice will see your payment forfeited.
Bookings for school term art classes for children and school holiday workshops are final and non-refundable or transferable in the event that you change your mind; you are only entitled to a refund if there is a major problem with the tuition service .
Acceptance of Children
The tuition provided by our studio is generally age specific and children under the age of sixteen years (16) may not attend adult tuition sessions under any circumstance. Children over the age of 16 may attend adult sessions only with express permission from a parent or caregiver – this can be done by emailing the Director at email@example.com
Adults may attend a children’s workshop only if they are accompanying their child/children already booked to attend that class or workshop. Where specific age groups are noted in advertised children’s art classes and workshops, it is at the studio’s discretion to include children outside of the advertised age range.
Children with special needs must be discussed with the studio before booking so that we can determine whether we have the skills and expertise to provide modified tuition. Consideration is given as to whether any special needs are outside the scope of our expertise for the safety of your child, our staff and other children attending. In the event that we can accommodate your child, we may also request a parent or caregiver remain with the child while they are attending an art class or workshop.
Cancellation by Us
We reserve the right to cancel or postpone any advertised art class, workshop or short course for a variety of reasons, including events outside of our control. In the event of cancellation or postponement you will have the opportunity to attend another date or transfer your booking to an alternative class, workshop or short course. If there is a difference in value we will provide a credit for the balance transferred to a lesser valued tuition service and should you choose to attend a greater value tuition service then you are liable to pay the balance of the value of the workshop. In some circumstances we may provide a refund in the event that we elect to cancel a class, workshop or short course.
We do not accept any liability for any damage, loss or injury to yourself or any member of your party or any vehicles or possessions, unless proven to be caused by a negligent act by ourselves or our employees or contractors whilst acting in the course of employment.
Copyright Law enforces protection of all information contained within the ART101 Gallery web site. Content from ART101 Gallery web site may not be copied, modified, published, transmitted, stored in a retrieval system, sold, reproduced, displayed or commercially exploited without prior written approval of its authors. All images on our site are used with permission for advertising purposes only and are Copyright by the artists concerned.
Information contained in the ART101 Gallery website is current and accurate at the time of uploading and is intended as general information only. Care and effort has been taken by ART101 Gallery to represent as true to actual colour as possible in digital format any artworks advertised. However variations may occur because of your computer settings. Wherever possible we ask that you view the artwork in our gallery to ensure that colours and dimensions are satisfactory.
Freight, Delivery and Installation
ART101 Gallery will not freight art works on your behalf. It is the buyer’s responsibility to engage a freight company that will provide a thorough service which should include wrapping and packaging and suitable insurance. ART101 Gallery must be notified in writing of your chosen carrier at least 48 hours before collection. We can recommend freight service providers should you require
ART101 Gallery does not provide installation services for artworks purchased from our gallery. We can recommend installation specialists for you to contact.
All prices are GST (Goods & Services Tax at a rate of 10%) inclusive. Overseas customers do not pay GST. However duties and/or taxes may apply to overseas destinations. These charges are the responsibility of the buyer and are non-refundable on return of goods to ART101 Gallery.
Methods of Payment
Purchases may be made online or by phoning ART101 Gallery directly. Online orders use a secure proven payment system through either PayPal or The Commonwealth Bank of Australia. We accept several payment methods and all options are designed to be as safe and secure as possible. Credit card details are not stored at any stage other than during the processing of your order. All information received from clients is strictly confidential. Your purchase will be dispatched once payment details are cleared or verified.
Payment by Credit Card : Master Card and Visa are accepted over the phone and in the gallery and all major credit cards are accepted for online through The Commonwealth Bank.
Payment by Eftpos: We offer Eftpos for purchases made on site in the gallery.
Payment by Bank Transfer: We only provide invoices for electronic transfer when the transaction is business to business. All other payments must be made using our other payment options.
Payment by Cash: We accept cash payments but do not keep a float in store so you should ensure that you have the exact amount for your purchase should you choose to pay in cash. A receipt is issued for all cash payments.
ART101 Gallery abides by the Privacy Act 1988. ART101 Gallery collects personal information for the processing of orders and shipping. This information may include your name, address, contact details and credit card information. ART101 Gallery will only use this information for the purpose for which it is provided and this information will not be used for any other purposes unless consent given. We do not store credit card details and any further purchases will require you to supply your relevant details at the time of purchase. ART101 Gallery respects your privacy and your personal information will be strictly secured. Your personal details will not be sold, passed on or swapped with any other organisation, business or individual unless expressly discussed for freight and installation contractors.
When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.
When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
Email marketing: All contact with ART101 Gallery automatically adds your details to our marketing database and we may send you emails about our gallery, new products, events and other updates.
Any data collected during the course of booking with, purchasing from or communicating with ART101 may be stored on our computer(s). We do not store credit card details. Any communication or interaction with ART101 will automatically add your details to our marketing database and we may from time to time, contact you about promotions and offers by way of electronic mail and SMS. We will not share your details with any third party.
